Maximalschutz im internationalen und europäischen Urheberrecht

Gegenüber dem stetigen Ausbau von Mindestrechten haben Maximalschutzgrenzen im Sinne einer zwingenden Begrenzung des urheberrechtlichen Schutzniveaus international und auch europäisch einen schweren Stand. Ein Novum ist hier die obligatorisch ausgestaltete Schranke des WIPO-Marrakesch-Vertrags von 2013 zugunsten sehbehinderter Personen. Der Autor nimmt diesen scheinbaren Paradigmenwechsel zum Anlass und untersucht, ob und wie sich Maximalschutzgrenzen in das bestehende System der Staatsverträge einfügen. Die maximalschützende Wirkung europäischer Vorgaben wird durch eine präzise Bestimmung der Reichweite der EU-Richtlinien sichtbar. In dem vorliegenden Band wird die erforderliche Methodik erarbeitet und an zentralen Punkten der europäischen Rechtsentwicklung erprobt.
 
The development of international and european copyright law is steadily transitioning to new minimum rights of the rightholders. On the other hand, mandatory exemptions are exceptional. Therefore the Marrakesh VIP Treaty of 2013 is a remarkable novelty. On behalf of blind and visually impaired persons, the author introduces a mandatory exception for the first time. Jan Hendrik Schmidt takes this as a reason to discuss how such exceptions can be implemented into the current system of international copyright law. Limitations can also arise from EU Directives. To determine them, it is necessary to use a precise methodology. This paper endeavors to present the required methodical cornerstones and applys them to key elements of the current european copyright system.
