Abstract
With constitutional law providing the conceptual structure, margins, and boundaries for criminal law and justice, the scholarly research in this area is confronted by two core challenges: First, criminal law and justice is politically configured and practically administrated beyond the nation state. Second, "modern" criminal law and justice serves more and more a regulatory function. Both of these challenges call for methodological reflections: How should the German "Dogmatik" of criminal law react? How should it align itself in relation to the politics of criminal justice as well as in relation to national and European constitutional law? These questions are addressed in this volume, which includes contributions to the memorial service for Joachim Vogel on 15 October 2014 and the subsequent international symposium on 16/17 October 2014.
