Abstract According to German law, a deed cannot be executed unless the notary reads the text to the parties aloud. If the agreement is extensive, this can be a time-consuming task. In practice, however, a welcome – and widely used – simplification is available by relegating the more intricate details to attachments which are then referred to in the main agreement. The author constructs different scenarios in order to determine under which circumstances schedules and exhibits must be referred to, and which simplifications apply in these cases. In particular, the author points to a potential clash of the statutory provision allowing reference to deeds executed with third parties for the sole purpose of referring to them in other instruments with the purpose of the requirement for execution before a notary. The thesis concludes with a reform proposal to remove the present possibilities for circumvention whilst extending the exemption from the duty to read documents aloud.
