The processing of data is of major importance for the ongoing digitalisation of agriculture. Traditionally, issues of data law were not a part of agricultural law but now become increasingly relevant. For the parties involved, the question arises as to whether, and, if so, to what extent, anyone has rights with regard to the processed data. It is often assumed that farmers have what is called data sovereignty. From the perspective of data protection and (intellectual) property law, Leonard Nicolay examines whether farmers actually have any rights with regard to the collection and processing of soil-related data and whether, in this respect, data sovereignty can be said to exist at all.
