Abstract In reaching a verdict, the judge is subject to the psychological anchoring effect, which influences his decision in the direction of a previously perceived numerical value. After reviewing the existing studies on the anchoring effect, there is a discussion as to whether the existence of such an effect under the current legal situation according to § 258 of the German Code of Criminal Procedure (StPO) constitutes a violation of the fair trial with regard to final speeches. This is followed by a critical examination of the necessity of reproducing the results through the author’s own empirical studies. In addition to reproduction, the author’s aim was to demonstrate potential compensation possibilities against anchoring effects. The statistical evaluation of his results is followed by a critical examination of them, in particular a new assessment of the question of a violation of the fair trial.
