Abstract The processes of globalisation and Europeanisation have diminished the capacity of the nation-state to set and enforce labour standards. At the same time, transnational private and hybrid (state/ non-state) actor constellations are increasingly taking over regulatory functions. In Europe, different forms of cross-border collective bargaining between capital and labour – so-called social dialogues – are gaining in importance. The book takes a closer look at transnational regulation in the area of anti-discrimination that belongs to the core tasks of the social state. Norm-building and implementation processes through social dialogues are examined by means of document analysis, expert interviews, selected case studies and diffusion analysis. The study focuses on the question whether social dialogues, whose legal basis is partly unclear, need stronger (supra-)state support and enforcement to meet social state objectives.
