Emotionen durchdringen das soziale Leben in all seinen Bereichen. Das gilt auch für das Recht, insbesondere im Kontext der Menschenrechte und der Aufarbeitung von staatlichem Unrecht. Die Autorin untersucht die emotive Durchdringung des Rechts im Kontext von Transitional Justice anhand der jüngeren strafrechtlichen Aufarbeitung der Diktaturvergangenheit in Argentinien. Im Fokus stehen kollektive Emotionsdynamiken, die sich in der gesellschaftlichen und juristischen Aufarbeitung im Spannungsfeld efferveszenter Kollektivgefühle, den rationalen Logiken des Rechts und seiner gleichwohl „heiligen“ Aura entfaltet haben. Ausgangspunkt der empirischen Betrachtung ist der mehrfach prämierte und dem Buch beiliegende Dokumentarfilm „Algo mío – Argentiniens geraubte Kinder“, der die Ambivalenzen einer emotiven Theorie des transitorischen Strafverfahrens in eindrucksvollen Bildern und fesselnden Geschichten zum Ausdruck bringt.

The author examines the emotive permeation of law in the context of transitional justice using the recent criminal justice process of dealing with the dictatorship's past in Argentina. The focus is on collective emotional dynamics that have unfolded in the social and legal reappraisal in the field of tension between effervescent collective feelings, the rational logics of law, and its nonetheless "sacred" aura. The starting point for the empirical examination is the documentary film "Algo mío - Argentina's Stolen Children," which has won several awards and is included with the book. It expresses the ambivalences of an emotive theory of the transitory criminal process in impressive images and captivating stories.
