Staatenimmunität im Konflikt mit dem Rechtsschutzanspruch des Einzelnen aus Art. 6 I EMRK

»The Right of Access to Court from Art. 6 ECHR in Conflict with State Immunity« The right of access to court has become a symbol of the constantly evolving position of individuals in public international law. In case of a conflict with the principle of state immunity, however, the European Court of Human Rights (ECtHR) takes the view that it has to withdraw completely or »in principle«, which, in the author's view, falls short of the minimum standard guaranteed under the ECHR. She proposes reconciling the interests involved while leaving both regimes the widest possible range of application. In this connection, the author appeals to the ECtHR, in accordance with its mandate under Art. 19 ECHR, to take seriously its responsibility for the practical and effective enforcement of the right of access to court under Art. 6 I ECHR.
