Abstract Victims of human trafficking are entitled to special protection and assistance under international law. The author analyzes the implementation of these duties of victim protection in the asylum procedure: Do victims of trafficking qualify for refugee protection? How can they be detected in the asylum procedure and how should the identification procedure be designed? How can their right to assistance and protection be guaranteed in the asylum procedure, and how does this relate to the “Dublin” procedure? The author comprehensively analyzes the international and European law of victim protection and presents practicable solutions for their implementation in the asylum procedure with a special focus on Switzerland. This book argues – based on a dogmatic as well as a practical analysis – for a human-rights-based and victim-centered application of the anti-trafficking provisions in asylum procedures and develops an identification model that may also be used outside asylum procedures.
