Subject in Dispute / Lis Pendens / Declaratory Model Judgment« With the declaratory model action, the legislator for the first time supplemented civil procedural law with a collective civil procedural instrument. The work focuses on the subject in dispute, lis pendens and the declaratory model judgement, which are examined dogmatically and classified systematically. Procedural implications are illuminated and the compatibility of the newly created type of action with civil procedural principles and constitutional requirements is examined.
