Gnade vor Recht?

Die interdisziplinäre Studie untersucht die strafrechtliche Praxis im österreichischen Vormärz anhand eines bislang übersehenen Aktenbestands der Obersten Justizstelle, des ehemaligen Höchstgerichts der Habsburgermonarchie. Die Arbeit beleuchtet die historischen Erscheinungsformen von Kriminalität und Devianz in Tirol und Vorarlberg. Zugleich zeichnet sie ein differenziertes Bild der vormärzlichen Strafjustiz, legt vorurteilsbehaftete Wahrnehmungen der Wiener Räte gegenüber der Bevölkerung des „italienischen Theils von Tyrol“ offen und gibt Aufschluss über die Spruchpraxis der Obersten Justizstelle sowie deren Interaktion mit unteren Instanzen. Durch die Verbindung traditioneller (straf-)rechtshistorischer mit innovativen kriminalitäts- und diskursanalytischen Ansätzen setzt die Studie neue Akzente und vermittelt neben Erkenntnissen zur österreichischen Strafrechts-, Kriminalitäts- und Sozialgeschichte auch Einblicke in die Alltagswelt des frühen 19. Jahrhunderts.
This interdisciplinary study examines criminal law practice in Austria during the Vormärz period on the basis of a previously overlooked collection of files from the Oberste Justizstelle, the former supreme court of the Habsburg Monarchy. The work sheds light on the historical manifestations of crime and deviance in Tyrol and Vorarlberg. At the same time, it paints a nuanced picture of criminal justice in the pre-March period, reveals the prejudiced perceptions of the Viennese councillors towards the population of the ‘Italian part of Tyrol’ and provides insight into the judicial practice of the Supreme Judicial Authority and its interaction with lower courts. By combining traditional approaches to criminal law history with innovative approaches to crime and discourse analysis, the study breaks new ground and, in addition to insights into Austrian criminal law, crime and social history, also provides insights into everyday life in the early 19th century.
